GENERAL TERMS OF USE
By entering into an agreement between the Operator and the User regarding the use of the website www.ihelp.si or the iHELP mobile app, you agree to these General Terms of Use. If you do not agree with these General Terms of Use, do not use the website www.ihelp.si, www.ihelp.life or the iHELP mobile app.
GENERAL
Operator: The Operator is iHELP Life d.o.o., Vrtnarija 8b, 1360 Vrhnika, Slovenia.
User: A User is any natural person who uses the website www.ihelp.si, www.ihelp.life or the iHELP mobile app.
CONCLUSION OF THE AGREEMENT
For the free iHELP Safety Plan: BASIC, the agreement between the Operator and the User regarding the use of the website www.ihelp.si or the iHELP mobile app is concluded when the User registers and creates their iHELP profile (user account). For the paid PLUS and PREMIUM plans, the agreement is concluded when the User registers, creates their user profile and pays the Operator the annual subscription fee. Upon payment of the annual subscription fee, the agreement is concluded for one year. The agreement may be renewed by paying the annual subscription fee for the following year.
USER REGISTRATION
The User logs in to the iHELP system on the website www.ihelp.si with a username and a password of their choice. The password is confidential and known only to the User. The User is responsible for keeping their password secure. The Operator is not liable for any loss or damage arising from the User's failure to comply with this security obligation.
A User who registers via the website www.ihelp.si or the iHELP mobile app activates their iHELP account (verifies their mobile phone number) and enters their personal details (first and last name, address, email address, phone number). In their profile, the User may also enter information about their health (age, weight, height, blood type, medical conditions, medications taken, allergies, whether they have a pacemaker, etc.). The User is responsible for the accuracy and currency of their personal data and for the content published in their profile. The User must promptly correct any published content that changes. The User can change the data in their profile in the following ways: via the mobile app, by registered post to the Operator's address, by email to the Operator, or via the website www.ihelp.si.
PERSONAL DATA PROTECTION
The Operator is committed to protecting the confidentiality of information it obtains from users of the website www.ihelp.si or the iHELP app.
The Operator collects personal data (such as names, addresses, email addresses, phone numbers, age, blood type, medical conditions, medications taken, allergies, whether the User has a pacemaker, etc.) that the User voluntarily provides in their profile. By providing personal data, the User expressly agrees that the Operator may use it in accordance with these General Terms of Use.
The purpose of collecting data on users' health is to enable paramedics or other users of the iHELP mobile app to obtain information about a user in urgent need of help when an SOS message is sent.
The User can switch on or off the circle of people (paramedics – iHELP mobile app users – relatives) to whom an SOS message containing their data is sent in an emergency. If the User selects the circle "iHELP mobile app users", the message will be sent to all iHELP mobile app users within a radius of 500 m or more from the User in need of urgent help. By selecting the circle of people to be notified by SOS message, the User expressly agrees and consents to certain personal data about the User being sent to all these people.
The Operator may use users' data only to inform users about new services, similar activities and news from the Operator. The Operator will not send the data to third parties or misuse it. The data is stored solely for rescue purposes (sending SOS messages and using the app). The Operator will not disclose the data to third parties, except at the request of a court or law enforcement authorities in the event of an attempted server breach.
The Operator retains users' personal data only while the User is active, i.e. while they have an activated profile and user account.
The User ensures that appropriate technical and organisational security standards, designed to protect the collected personal data of users against accidental, unlawful or unauthorised destruction, loss, alteration, access, disclosure or use, remain in force.
Under applicable law, the User has rights that may include access to their personal data processed by the Operator, the right to rectification, erasure or blocking of the use of such personal data, and the right to object to certain types of data processing. To exercise these rights, the User must submit a written request addressed as described in the "Questions" section below.
USAGE TRACKING ("Cookies")
The Operator automatically tracks how the content available on the Operator's website www.ihelp.si is used. This means that the Operator may collect and process data about visits to the website www.ihelp.si, for example for visitor statistics and for user registration ("login"). In doing so, a "cookie" will be placed on the User's computer, through which the Operator obtains information about the User's domain name, the User's internet service provider, and the date and time of the User's access. A "cookie" is a piece of information sent to the User's browser and stored on the computer's hard drive, which allows the Operator to track use of and visits to the website www.ihelp.si in more detail. If the User disables or blocks "cookies", they will still have exactly the same access to the content on the website www.ihelp.si; this will only result in slightly less accurate data on visits to and use of the website www.ihelp.si that the Operator collects in its internal reports. This visitor data will be used solely for the Operator's internal purposes.
PROTECTING THE PRIVACY OF MINORS
The website www.ihelp.si and the iHELP app are not intended for children and young people under the age of 14. Children under 14 must not submit personal data via the website or the app. The Operator does not store personal data of persons under 14.
PAYMENT
Prices for iHELP premium services are available on the website www.ihelp.si.
LIMITATION OF THE OPERATOR'S LIABILITY
The mobile app effectively increases the chances of rescue and reduces the time it takes to provide first aid. By forwarding an SOS message, the iHELP mobile app connects the User with the nearest emergency service via the 112 number.
The iHELP mobile app does not guarantee survival or a response to a call for help. The iHELP mobile app increases the likelihood of survival and the chance of a fast rescue. The app itself does not save lives – people save lives.
The iHELP mobile app and the information and content within it are not intended to replace or substitute professional medical care, emergency medical services, an official first aid course or basic life support training. The app is not intended to replace or substitute medical staff.
The Operator strives to ensure the full technical functioning of the website www.ihelp.si and the iHELP mobile app. The Operator is not liable for any direct or indirect damage or inconvenience that the User may suffer as a result of any technical problems or interruptions in the operation of the iHELP mobile app.
The User agrees that the Operator is not liable for any direct, indirect, incidental, special, consequential or exemplary material or non-material damage arising from the User's use of the website www.ihelp.si or the iHELP mobile app.
The Operator does not guarantee the flawless operation of the iHELP mobile app or the accuracy of the information provided. Errors may occur in the operation of the app itself, as well as in the use of navigation systems (the User's GEO location) as a result of local environmental conditions and/or incomplete or incorrect data. If the User has GEO location switched off, the iHELP mobile app cannot include the User's GEO location in the SOS message to paramedics, and paramedics will therefore not be informed of the location of the casualty or third party in need of urgent help.
The iHELP mobile app successfully sends an SOS message to the selected circle of people (paramedics – iHELP mobile app users – relatives) only when a working or available GSM signal is present. If the User is in an area without GSM coverage, or the GSM signal is not working, the SOS message will not be sent, and the Operator is not liable for any inconvenience or damage the User may suffer as a result.
When the User sends an SOS message, the iHELP mobile app informs them of the nearest defibrillator location. The Operator obtained part of the list and locations of defibrillators from the website www.aed-baza.si, managed by the Faculty of Medicine of the University of Ljubljana, and from other databases. The Operator therefore does not guarantee the location of defibrillators or their flawless operation, and is not liable for any direct or indirect damage or inconvenience the User may suffer as a result of defibrillators not working or being incorrectly located.
PROHIBITION OF MISUSE AND SANCTIONS
Using the iHELP mobile app for any purpose other than rescue is prohibited. Misuse of signals for help and danger (SOS messages) is a criminal offence (Article 309 of the Criminal Code of the Republic of Slovenia, KZ-1). In the event of misuse of the iHELP mobile app, the User shall bear the costs of the intervention.
If misuse is detected, the Operator will block the User's SOS messaging service and notify them via the mobile app, by registered post to the User's address or by email.
The User is also liable for misuse of the mobile app and SOS messages if the medium or "smart" mobile device on which the iHELP mobile app is installed is lost or stolen. If the medium or "smart" mobile device on which the iHELP mobile app is installed is lost or stolen, the User must notify the Operator as soon as possible so that the Operator can block the SOS messaging service and thus prevent possible misuse.
CHANGES TO THE GENERAL TERMS OF USE
The Operator reserves the right to update and amend the General Terms of Use of the website www.ihelp.si or the iHELP mobile app, as well as the price list. Continued use of the services after any such changes means that the User expressly agrees to them. If the User does not agree with the amended General Terms of Use or price list, they may cancel their user account at any time; however, the subscription fee paid for the current year will not be refunded.
The Operator will notify users of any change to the price list 1 month before the change takes effect, via the mobile app or by email.
GOVERNING LAW
Legal relationships under these General Terms of Use relating to the use of the website or the iHELP mobile app are governed by the law of the Republic of Slovenia.
In the event of a dispute between the User and the Operator, the courts of the Republic of Slovenia have exclusive jurisdiction.
